Exception rows and footnotes in the construction table
The two exception rows in the construction size-standard table, the footnotes printed with them, and the source wording that FGExperts reproduces as printed.
Two rows in the construction part of 13 CFR 121.201 are marked as exceptions. Each carries a footnote, and the footnote limits when the figure applies.
Dredging and surface cleanup (exception row)
The table prints the row as 237900 (Exception), Dredging and Surface Cleanup Activities, with a standard of $37.0 million and footnote 2. Footnote 2 says that, for Government procurement, a firm or its similarly situated subcontractors must perform at least 40 percent of the volume dredged with their own equipment or with equipment owned by another small dredging concern.
The footnote names NAICS code 237990 as the dredging activity, while the row is printed as 237900. FGExperts reproduces the table and the footnote as printed and does not correct either. Check the official text before you rely on the row.
Building and property specialty trade services (exception row)
The table prints a second exception row, 238990 (Exception), Building and Property Specialty Trade Services, with a standard of $19.0 million and footnote 13. Footnote 13 says that where a procurement requires multiple specialty trade contractors (for example plumbing, painting, plastering or carpentry) and no specialty trade accounts for 50 percent or more of the value of the procurement, all of those activities are considered a single activity classified as Building and Property Specialty Trade Services.
What to do with an exception row
An exception row applies only to the situation its footnote describes. Read the footnote, confirm that your procurement or your activity fits it, and check the official eCFR text for the current wording. The calculator marks exception rows so that the footnote is shown next to the figure.
