Terms of Service

These Terms of Service ("Terms") are an agreement between you and GCExperts LLC ("we", "us") governing your use of FGExperts at fgexperts.net ("the Service"), a website about SBA size standards for federal construction contractors (NAICS 236, 237 and 238). By creating an account or using the Service you agree to these Terms.

1. The Service

The Service provides information and membership features related to SBA size standards for federal construction contractors (NAICS 236, 237 and 238). We may add, change, or remove features over time. We do not guarantee any particular result from using the Service.

2. Accounts

You must provide a valid email address and keep your password confidential. You are responsible for activity under your account. You must be at least 13 years old, and old enough to enter this agreement where you live, to create an account.

3. Subscriptions, renewals, and refunds

The paid membership is a $39 a month subscription. Payments are processed by Stripe. A subscription renews automatically every month until you cancel. The amount and the renewal date are shown before you pay, and the subscription continues at the same monthly price each month until you cancel it.

How to cancel. You can cancel at any time from your account page, or by emailing [email protected]. When you cancel, the subscription stops renewing and your membership stays active until the end of the period you have already paid for; after that date it does not renew and access ends. We do not bill you again after you cancel.

Failed payments. If a renewal payment fails, Stripe retries and we may pause your membership until the payment succeeds. If the subscription becomes past due and is not brought current, membership access ends.

Refunds. If you believe you were charged in error, contact [email protected] within 14 days of the charge and we will review a refund in good faith. Nothing in these Terms limits any non-waivable refund right you have under applicable law.

Grandfathered purchases. If you bought the older one-time membership, your access is kept as it was and you are not moved to a monthly subscription. Any existing one-time purchase does not begin recurring billing.

4. Acceptable use

You agree not to:

• break the law or infringe anyone's rights, including intellectual-property rights;
• impersonate any person or business, or misrepresent your affiliation;
• attempt to access accounts, data, or systems you are not authorised to access;
• interfere with the Service, including by scraping, overloading, or introducing malicious code.

5. Intellectual property

The Service, its content, and its branding are owned by us or our licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, resell, or redistribute the Service except as allowed by law.

6. Third-party services

The Service relies on third parties such as Stripe for payments and our email provider for transactional email. Their terms and privacy practices apply to those parts of the Service. Stripe issues the receipt for each monthly charge.

7. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any information it contains is accurate or complete.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim, or USD 100 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnity

You agree to indemnify and hold us harmless from claims and costs arising from your misuse of the Service or your breach of these Terms, to the extent permitted by law.

10. Termination

You may cancel your subscription and stop using the Service at any time, and you may request deletion of your account at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service.

11. Changes to these Terms

We may update these Terms. When we do, we will revise the "Last updated" date and, for material changes, provide a prominent notice. Continued use after a change means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules, and the courts located there will have jurisdiction, except where mandatory consumer-protection law gives you the right to bring a claim where you live.
